Committee constituted for Revision of Delhi Minimum Wages as per Supreme Court

Order for Committee constituted vide direction of Hon’ble Supreme Court for fixation revision of Minimum Wages

Office of the Secretary-Cum-Labour Commissioner, Govt. Of NCT of Delhi issued Order vide F.No.140/Addl.LC/Lab/Action/CWP-8125/2018 /273 dated: 06.11.2018 regarding Committee constituted for Revision of Delhi Minimum Wages as per Supreme Court and detail as follows

The Hon’ble Supreme Court in SLP no. 26185-26228/2018, GNCT of Delhi Vs Flt.Lt. Rajan Dhall Charitable Trust & Ors. etc. vide its order dated 31.10.2018 has directed the Govt.of NCT of Delhi to re-do the exercise of fixing the minimum wages for the scheduled employments afresh following route prescribed either under section 5(1)(a) or 5( I)(b) of the Minimum Wages Act 1948 and lay the proposed notification regarding rates before the Hon’ ble Court at the end of 3 months.

In view of the above directions of Hon’ble Supreme Court. Price Committee comprising of 4- officers has been constituted which is as under:-

(i)            Sh. Lallan Singh, Joint Labour Commissioner- Chairman.

(ii)           Sh. Amardeep, Assistant Labour Commissioner- Member.

(iii)          Sh. Shashi Bhushan, Labour Officer- Member.

(iv)         Sh. Manish Kumar Thakur, Inspecting Officer- Member.

For fixation/ revision of minimum wages, 15th Indian Labour Conference held in 1957 has laid down following components of wage fixation which are food, clothing, housing, fuel/ light and other misc. items. However, the Hon’ble Supreme Court in its judgment in the case of Reptakos Brett & Co. Ltd. -1991 which is related with minimum wage fixation/ revision has added 5’11 component i.e. Education, Medical requirement and social obligations in addition to 4 components laid down by 15th Indian Labour Conference held in 1957.

The said committee shall collect/obtain cost of various food components/ items as laid down by National Institute of Nutrition (NIN)- Hyderabad, an autonomous body under Indian Council of Medical Research(ICMR), GOI, prescribing intake of 2731 Kilo Calories per day by a worker to perform moderate activities and also cost of clothing component.

The said committee shall obtain/collect price/cost of various food components from Govt. outlets i.e. Kendriya Bhandar, Mother Dairy, Safal outlets and shall also obtain/collect price/cost of clothing component from Govt. outlet i.e. Khadi Gram Udyog.

The said Committee shall give its report regarding price collection in respect of food items and clothing component within 5 days of its constitution or earlier.
